Õppeaine eesmärk on anda üliõpilastele baasteadmised tsiviilõiguse üldosa kohta. Eelkõige on eesmärgiks anda üliõpilastele teadmised tsiviilõiguse üldalustest (sh põhilised tsiviilõiguse instituudid, põhimõisted ja põhiprintsiibid) valmistamaks üliõpilasi ette tsiviilõiguse allharude (võlaõigus, asjaõigus, perekonnaõigus, pärimisõigus) ja laiemalt eraõiguse allharude (nt äriõigus) edasisteks õpinguteks.

The purpose of this course is to obtain general knowledge of the main features of the European private law systems, understand the main concepts of the Civil Law’s conception of a „General Part“, to be able to orientate in European private law systems, legal sources and literature, and to obtain basic skills of drafting legal opinions in a sound and thorough method.

Kursuse eduka läbimise tulemusena omab üliõpilane baasteadmisi tsiviilõiguse üldosast (eelkõige TsÜS) ja selle kohast õigussüsteemis; tunneb Euroopa Liidu poliitika arenguid selles valdkonnas; mõistab tsiviilõiguse põhiinstituute, põhimõisteid ja põhiprintsiipe; omab piisavat ettevalmistust edasisteks eraõiguse õpinguteks.

By the end of the course the student:
- Has a thorough understanding of the general part of European private law systems, including major EU policy developments in this area
- Is able to identify the basic tools and instruments of private law and work with them and

Kursus keskendub peamiselt tsiviilseadustiku üldosa seaduse (TsÜS) käsitlemisele, kuid kursuse käigus käsitletakse ka muid seadusi (nt võlaõigusseadus, asjaõigusseadus, perekonnaseadus, pärimisseadus, äriseadustik jt) vajalikus ulatuses. Kursuse sisuks on selgi¬tada tsiviilõiguse olemust ja struktuuri ning õpetada üliõpilasi rakendama tsiviilõiguse üldpõhimõtteid esialgu edasistes õpingutes ning hiljem praktikas.
brief description of the course in English
The application of the provisions of general part-serving elements of European private law systems is exercised by cases covering the fields of formation of contracts (declarations of intent), legal capacity, representation, avoidance, and general part problems in connection with special fields of private law (law of obligations, property law, family- and succession law), which are solved during class applying the „gutachtenstil“-method. This logically clean and very precise procedure of analysing a legal case has been standard in German law family legal systems since the late 1800ies and provides – based on a juridical syllogism - sound and reliable solutions.
