Kursus käsitleb erinevusi kohtumenetluse ja selle alternatiivide vahel ning selgitab, millal peaks valima ühe või teise vaidluste lahendamise mehhanismi. Kursuse üldeesmärk on anda teadmised vaidluste lahendamise alternatiivsetest võimalustest sõltuvalt vaidluse spetiifikast, kuid samas käsitletakse ka lepituse ja arbitraazi põhiaspekte.

The course addresses differences between court procedure and its alternatives, and explains when one should prefer one or another way of dispute resolution. General objective of the course is to provide the audience with knowledge on alternative ways of dipute resolution by introducing existing opportunities for specific types of disputes, but also addressing core aspects of mediation and arbitration.

Kursuse läbinud üliõpilane:

- rakendab algteadmisi, mis on vajalikud niisuguses vaidluse lahendamise protsessis osalemiseks.

Tegemist on üldise vaidluste alternatiivse lahendamise kursusega. Kursus algab sissejuhatusega konfliktide juhtimisse ja läbirääkimistesse, millele järgneb põhjalikum vahendamise ja arbritaazi tutvustamine, nende rakendamisvõimalused ja menetlus. Kursus ei põhine vaid ühel konkreetsel vaidluse lahendamise võimalusel, ülevaade antakse erinevatest võimalustest. Üliõpilane omandab põhioskused, mis on vajalikud niisuguses menetluses osalemiseks.
brief description of the course in English
This is a general course on alternative dispute resolution. The course starts with a brief introduction to conflict management and negotiations, followed by a more detailed introduction of mediation and arbitration, their areas of application and processes. The course shall not focus on the resolution of any particular type of dispute. The main aim of the course is to introduce the core aspects of existing dispute resolution opportunities and enable students to acquire some basic skills necessary for participating in such processes.
