Kursuse eesmärk on anda oskused rakendada õiguslikke süllogisme, analüüsides õiguslikke kaasuseid, samuti omandada teadmisi Euroopa eraõiguse süsteemidest, mõista peamisi tsiviilõiguse üldosa põhimõtteid ning orienteeruda Euroopa eraõiguse süsteemides, õigusallikates ja -kirjanduses.

The purpose of this course is to obtain skills to use and practice legal syllogisms when analysing a legal case as well as to obtain general knowledge of the main features of the European private law systems, understand the main concepts of the Civil Law's conception of a General Part, to be able to orientate in European private law systems, legal sources and literature.

- selgitab Euroopa eraõiguse süsteemide üldosa, sh peamisi EL poliitikate arenguid selles valdkonnas;
- tunneb ära eraõiguse peamised vahendid ja töötab nendega;
- analüüsib kaasuseid ja koostab õiguslikke arvamusi.

After completing this course the student:
- explains the general part of European private law systems, incl. major EU policy developments in this area;
- identifies the basic tools and instruments of private law and works with them;
- analyses cases and drafts legal opinions.

Euroopa eraõiguse süsteemide üldosa normide rakendamine läbi kaasuste lahendamise, hõlmates lepingute koostamist (tahteavaldus), õigusvõimet, esindust ja selle tühistamist ning muid üldosa küsimused seotult tsiviilõiguse eriosaga (võlaõigus, asjaõigus, perekonna ja pärimisõigus). Kaasuste lahendamisel rakendatakse õigusliku süllogismi metoodikat.
brief description of the course in English
The application of the provisions of general part-serving elements of European private law systems is exercised by cases covering the fields of formation of contracts (declarations of intent), legal capacity, representation, avoidance, and general part problems in connection with special fields of private law (law of obligations, property law, family- and succession law), which are solved during class applying the legal syllogistic method.
